The PanHellenic Animal Welfare and Environmental Federation requests from the Constitutional Court, the annulment of the Decision for the slaughters of animals in religious rituals.
A petition has been filed, before the presence of the Constitutional Court,by our Federation against the Ministry of Rural Development and Food with the intent of the annulment of the Joint Ministry’s Decision in reference to the slaughter of animals in slaughterhouses within the context of religious rituals.
This decision, which is defined as ”the definition of additional measures for the enforcement of the European Regulation/2009”, substantially comprises a direct deviation from the enforcement of the aforementioned regulation.
It should be noted that our country has a history of breach of European instructions in reference to animals. In addition, the Court of Justice of the European Union, with its verdict on 10/09/2009,condemned our country due to the systematic breach of instructions in relation to the protection of animals;specifically, the circumstances surrounding their transportation, and either their slaughter or their execution.Furthermore,we have been warned of indictment before the Court of Justice of the European Union pertaining to cages in consecutive rows, etc.
Through the contested Joint Ministerial Decision, the government is attempting to ”legalise” a wholly barbaric practice of executing animals within the context of religious events, for the sake of its ”investment” politics, thereby violating the Constitution, the European Union Legislation and National Legislation.
Despite the efforts of the Ministry,as it claims in the relevant preface of the decision to depict that its intention was to ensure a broader sphere of protection of animals, the reality is,that with the new legislative decree, the slaughter of animals without anaesthesia has been both confirmed and validated,as opposed to previous legislatures. With the totally comprehensive legal petition for annulment,it is proved that besides the torturous deaths of animals without anaesthesia as well as the violation of National Legislation which prohibits slaughter in this manner, unconstitutional procedures which establish ”exceptions” in relishing the rights of religious consciences and freedom in favour of a religious minority, are legalised via the aforementioned decision.Antithetically, regarding both Greek and non-Greek citizens who are not members of such a minority, grave penal and administrative ramifications will be incurred, as according to our national law.
Our Federation, as well as hundreds of thousands of citizens, are opposed to these acts of violence against animals, and their objective is the safegaurding of animals from torture.Their opposition is in no way whatsoever correlated to religious consciences and convictions, condemning torture, irrespective of Christian,Muslim,Jewish descent or any other religion.
We would like to thank our attorneys Mr.Vasili Papageorgiou and Mrs.I.Koufaki,in Athens and Brussels respectively, for their pro bono contributions and co-operation for the preparation of the litigation of the petition for the annulment of the aforementioned decision in the most sterling manner.
